OVERVIEW

This website is operated by Secasa Home (“we”, “us”, “our”). By visiting our site and/or purchasing from us, you agree to be bound by these Terms of Service (“Terms”), including additional policies referenced herein or linked on our site (e.g. Privacy Policy, Shipping & Returns Policy, Warranty Policy). If you do not agree to the Terms, you may not access or use the Services.

Our store is hosted on Shopify Inc., which provides the e-commerce platform enabling us to sell our products and services to you.


1. ONLINE STORE TERMS

You represent that you are at least the age of majority in your jurisdiction, or you are the age of majority and have given consent for any minor dependants to use this site under your supervision. You must not use our Services for unlawful or unauthorised purposes or violate any applicable laws.


2. GENERAL CONDITIONS

We may refuse service to anyone at any time for any reason permitted by law. Content (excluding payment card details) may be transferred unencrypted over networks and adapted to technical requirements. Payment information is always encrypted during transfer.


3. ACCURACY, COMPLETENESS & TIMELINESS

Materials on the site are provided for general information only. We do not warrant that information is accurate, complete, or current. Product availability, specifications, and pricing may change without notice. You agree it is your responsibility to monitor changes.


4. PRICES, TAXES & PROMOTIONS

Prices are in AUD and include/exclude GST as indicated at checkout or on product pages. We may change prices and promotions at any time. If an obvious pricing or listing error occurs, we may cancel and refund the affected order or request your confirmation at the corrected price (no additional liability to you other than a refund).


5. PRODUCTS & SERVICES

Certain products may be available exclusively online and/or in limited quantities. Colours and finishes may appear differently on different screens; minor visual variance is not a defect. We may limit sales by person, household, region, or order, and discontinue products at any time.

Pre-order / Special-order / Custom items: lead times are indicative only; production changes may occur outside our control. Custom and special-order items are generally non-cancellable and non-returnable, except as required by law (see Shipping & Returns Policy and ACL section).


6. ORDERS, ACCEPTANCE & AVAILABILITY

Your order is an offer to purchase. We accept your order when we send a dispatch confirmation. If a product is unavailable, discontinued, or mislisted, we may cancel the order and process a refund. We may limit or cancel quantities per account, payment card, billing/shipping address, or orders that appear to be placed by resellers/distributors.

You agree to provide current, complete, and accurate order and account information and to update it promptly.


7. SHIPPING, RISK & TITLE

Shipping, delivery windows, and fees are governed by our Shipping & Returns Policy (incorporated by reference). Title to goods passes to you upon full payment. Risk of loss or damage passes upon delivery as defined in the Shipping & Returns Policy (including where Authority to Leave (ATL) is elected) or upon pickup for Click & Collect.

Delivery timeframes are estimates only and may be impacted by carrier delays, public holidays, industrial action, extreme weather, or other factors beyond our control.


8. CLICK & COLLECT

Where offered, Click & Collect is available only after you receive “Ready for pickup” confirmation. You must present order details and valid ID. Inspect items at collection; risk transfers to you upon pickup.


9. INSTALLATION, LICENSED TRADES & COMPLIANCE

Unless explicitly stated, prices exclude installation. Plumbing and electrical products must be installed by licensed tradespersons in accordance with applicable Australian Standards and local regulations. Damage arising from improper installation, misuse, or non-compliant conditions may void manufacturer warranties and is not our responsibility.


10. RETURNS, CANCELLATIONS & WARRANTY

Our Shipping & Returns Policy and Warranty Policy (each incorporated by reference) set out change-of-mind returns, cancellations, exclusions, restocking fees, refund timelines, and warranty procedures. To lodge a warranty claim, follow the instructions in the Warranty section and provide installer details (where applicable). Return-to-base inspection/testing may be required; who pays for transport will depend on the circumstances and your rights under the ACL.


11. THIRD-PARTY SERVICES & LINKS

We are not responsible for third-party websites, services, tools, or materials, and we provide access “as is”. Your use is at your own risk and subject to the third party’s terms.


12. USER CONTENT & REVIEWS

If you submit content (e.g., reviews, comments, images), you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce, publish, and display such content in connection with the Services and our marketing. You warrant you own or have rights to the content and that it does not infringe others’ rights or applicable laws. We may moderate or remove content at our discretion.


13. PROHIBITED CONDUCT

You must not use the site or its content for unlawful purposes; infringe IP or privacy rights; upload malicious code; collect or track personal information without consent; spam; or circumvent security features. We may suspend or terminate access for violations.


14. INTELLECTUAL PROPERTY

All site content (excluding user content) is owned by or licensed to us and protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without our prior written consent, except as permitted by law.


15. DISCLAIMER OF WARRANTIES

Except as required by law or expressly stated, the Services and all products are provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, durability, title, and non-infringement.


16. LIMITATION OF LIABILITY

To the maximum extent permitted by law and subject to your non-excludable rights under the ACL, we are not liable for indirect or consequential loss (including loss of profit, revenue, savings, data, goodwill, or business opportunities). Where liability cannot be excluded, it is limited to, at our option, replacement, repair, re-supply, or the amount you paid for the relevant product(s). Our liability will be reduced to the extent you caused or contributed to the loss.

Nothing in these Terms excludes, restricts, or modifies any right or remedy you have under the Australian Consumer Law (ACL).


17. INDEMNITY

You agree to indemnify and hold harmless Secasa Home, our affiliates, officers, employees, and agents from claims arising out of your breach of these Terms or violation of law or third-party rights.


18. FORCE MAJEURE

We are not liable for delay or failure to perform due to events beyond our reasonable control, including natural disasters, epidemics, war, strikes, labour disputes, utility failures, carrier disruptions, or government actions.


19. PRIVACY

Your submission of personal information is governed by our Privacy Policy. We use Shopify and other service providers to process data in accordance with that policy and applicable law.


20. GOVERNING LAW & DISPUTES

These Terms are governed by the laws of New South Wales and Australia. You submit to the non-exclusive jurisdiction of the courts of NSW and the Commonwealth of Australia.


21. CHANGES TO TERMS

We may update these Terms by posting a revised version on our site with the “Last updated” date. Continued use of the Services after changes constitutes acceptance.
